Former Governor of Kaduna State, Nasir El-Rufai, don file N1 billion fundamental human rights suit for Federal High Court, Abuja, against Independent Corrupt Practices and Other Related Offences Commission (ICPC), police and other authorities over wetin he call unlawful invasion of him house.

 

For the suit wey get number FHC/ABJ/CS/345/2026, El-Rufai list ICPC as first respondent. Others wey he join for the case include the Chief Magistrate of FCT Magistrate Court, the Inspector-General of Police and the Attorney-General of the Federation.

 

Through him lawyer, Mr Oluwole Iyamu (SAN), the former governor dey ask the court make dem cancel one search warrant wey one Chief Magistrate for FCT allegedly issue on February 4. The warrant allow security operatives search and seize items from him house for Abuja.

 

El-Rufai argue say the warrant get serious problems. According to am, the document no clearly state the items wey dem wan seize, get drafting errors and unclear instructions, and no get probable cause before dem issue am.

 

He talk say because of all these mistakes, the search break him constitutional right to privacy under Section 37 of the 1999 Constitution (as amended).

 

The former governor also ask the court to declare say the way ICPC and police invade him residence for House 12, Mambilla Street, Aso Drive, Abuja on February 19 violate him rights to dignity, personal liberty, fair hearing and privacy under Sections 34, 35, 36 and 37 of the Constitution.

 

El-Rufai still dey seek order make the respondents no use any item wey dem seize from him house as evidence for any court matter, insisting say anything wey dem collect through unlawful warrant no suppose stand for law.

 

Among the reliefs wey he dey ask for na order wey go compel ICPC and the Inspector-General of Police to return all items wey dem carry from him house immediately, plus full inventory of wetin dem seize.

 

He dey demand N1 billion as general, exemplary and aggravated damages for alleged trespass, unlawful seizure, psychological trauma, humiliation and damage to him reputation.

 

Breakdown of the money show say:

• N300 million as compensation for emotional distress and loss of personal security.

• N400 million as exemplary damages to stop future alleged misconduct by law enforcement agencies.

• N300 million as aggravated damages for what he describe as oppressive execution of defective warrant.

• N100 million as cost of the legal action.

 

For affidavit wey support the suit, Mohammed Shaba, wey be Principal Secretary to the former governor, talk say officers from ICPC and Nigeria Police Force storm the residence around 2pm on February 19, using warrant wey dem allegedly issue earlier that month.

 

Shaba claim say the warrant no specify the items wey dem wan search for, and say the officers no follow proper procedure before dem carry out the search. He also allege say dem seize personal documents and electronic devices wey dem never return.

 

El-Rufai base him argument on provisions of the Administration of Criminal Justice Act, 2015, and the ICPC Act, 2000, insisting say the warrant no meet legal requirements.

 

As at now, court never fix date to start hearing the case.
